Noise ordinance violation dismissed

City attorney Randy Ray recently sent this update to the City Council regarding the noise ordinance violation against Caleb Matheny, president of the Sigma Nu fraternity on Bradley’s campus:

Sonni Williams has looked into this ticket which was issued at the Sigma Nu house. She has spoken with the officers who were present and has determined that we cannot prove a case against Mr. Matheny. There is a report that loud voices could be hear 500 feet away, but we cannot prove whose voices were heard. Accordingly, this ordinance ticket is being dismissed.

Matheny is suing Second District Council Representative Barbara Van Auken over the incident that led to the noise ordinance ticket being issued.

  1. Good news– cooler heads and logic have prevailed.

Waiting for Billy’s take on this..I’m sure some type of conspiracy between Randy Ray and Kevin Lyons……

  2. What it really means is that some of the officers involved would not testify that the Frat was making noise. Even the officer that was forced to write the ticket in the first place.

  3. S. Williams what a joke the city has no clue how much of an idoit thas woman really is she lies all the time ,but they don’t care as long as she bring’s the money honest or dishonest the city doesn’t care. Just more money to WASTE !!!!!!! . i KNOW THAT THE CITY HOPES THAT ,NO TICKET MEANS NO LAWSUIT GOOD LUCK the only times the city listens is to a lawsuit.

  5. Am I the only who thinks it is a bit coincidental that just when Sig Nu finally pulls action against Babs, that the city miraculously says there is no basis for the noise ticket and drops it? I think someone is trying to cover their ass and hope that the Sig Nu boys take it easy on their favorite district representative.

  6. “What it really means is that some of the officers involved would not testify that the Frat was making noise. Even the officer that was forced to write the ticket in the first place.”

I’d like to see some evidence for that HUUUUUUUUUUUGE assumption.

  7. Queuing video in 5, 4, 3, 2,…… hey… you do have the video right? … um…. right?

  8. It was made as a statement of fact…. think about it… “What it really means”… that is not stating an opinion.
“Even the officer who WAS FORCED…”

Reads like you are stating facts as you know them to be true…

Emtronics… do you only tell the truth in court?

  9. The Officer was forced (ordered) to write the ticket. The Bradley Sgt (a woman) said she can’t testify she heard the Frat because she didn’t. Those are the facts. Happy? I heard them straight from an officer’s mouth.

  10. I recall Sonni Williams having a direct connection to Citizens for Community Values (CCV)….Sandi….I’m forgetting her name. The CCV church ladies see Van Auken as a menthol sucking, pro abortion, bra burning feminist, stumbling around the neighborhood with Andy Randy and the other [offensive phrase deleted by blog owner] stomping around the West Bluff.

Regardless of their politics or gender, I think the four letter expletive used by Attorney Joe Napoli to describe Sonni, is at times applicable to any and all of them.

Ah, but a few moments with my lovely wife with cleanse the thought of any of them.

  11. I don’t believe they have any coherant video. If they did it would be splattered all over the interplex by now.

  12. The Journal Star has this story now.

I agree: Either the noise ordinance is totally enforceable without a recording taken the required distance away, or the officers weren’t prepared to testify that they heard the noise a required distance away, or the city administration just decided to hang BVA out in the cold.

The frat can answer th4ese questions by releasing the video they claim to have.

  13. maybe negotiations are occurring, thru back channels, and the video which DOES EXIST, is part of those discussions. sigma nu is not out for revenge, is not political and has no interest in unnecesarily embarrassing anyone – they simply want to be respected as citizens and treated fairly.

someimtes the easiest explanation is the right one.

  14. Bill: It is just another tool that will work in some circumstances. The Chief understands that no one method is a cure all. He is taking an holistic approach. I like the approach because it is cost effective, safer and is a carrot and stick approach that is appreciated even by thugs. Any one of those little thugs running around is only a few years away from being a positive mentor or a drug and alcohol counselor. If you don’t believe me, ask General Parker.

  15. “sigma nu is not out for revenge, is not political and has no interest in unnecesarily embarrassing anyone”

When was the last time you hung around fraternity kids?
Two of the favorite TV shows of this group are Jackass and Punked.

Not political, I agree with… they are way too self absorbed to be interested in anything except themselves. Maybe 10% of them vote? But 90% play GTA and Far Cry.

  16. Chase, I also agree with you, especially if used very, very cautiously so as not to allow these kids to play games with the system–that is also what happens in District 150.

  17. kcdad-
though never a member of a fraternity and my college did not allow frats or sororities, i have been around fraternity kids, even the sigma nu’s. did not observe any of them play the games you mention (but i’ve never heard of the games til your mention). i do know that these young men are more motivated in their education and life and politically aware than i was at that age (and i turned out ok i think). but they are still college age and occassionally engage in things that (most responsible) adults don’t.

  18. CJ,
You have chided others in the past for a lack of civility.
Why do you permit such hateful venom from Mr. Ingersoll on your site?

  19. PeoriaGuy:

My post was on the connection or controversies between other personalities. I think you have to know of the past animus’ in order to contextualize the current controversy and motivations behind public actions. Also, if you had as many heterosexually challenged friends as I, you would know that [offensive phrase deleted by blog owner] is a term of endearment.

  20. kcdad: “Two of the favorite TV shows of this group are Jackass and Punked”

My son graduated from Bradley. I take exception to that comment. You are either an idiot or an idiot.

Using your stereotyping, then all councilpersons are loud cop poking drunks.

  21. The fact that kc uses the acronym GTA makes it seem as though he has spent quite a lot of time playing it, no typical old person would otherwise use it or know what it stands for.

  22. This is getting pretty trippy here Billy, but in the process of making your post didn’t you just negate it by virtue of doing the exact same thing you were opposing? 🙂

  23. Em: Take exception if you wish. You lack of open mindedness is evident in your inability to come up with an alternative to idiot… seems like that is representative of a lack of vocabulary skills

11bravo: there is nothing typical about me. I also know the abbreviations for the CIA and NAACP but have never been involved with either of those organizations.

Please don’t project your ignorance on others.

  24. kcdad: I was trying to be civil, no lack on my vocabulary at all. Talk about someone not being open minded? Have you looked in a mirror lately? This isn’t my blog so I was being nice. If this was my blog, I would have simply pegged you as an as*ho*e. Sorry if I offended.

  25. I would have to load up your opinion with some weight to be offended.
“You are either an idiot or an idiot.” VERRRRRRRRY civil.
BTW… an idiot is someone with an IQ score measuring below 20. I am sure you knew that, which is why I commented on your extensive vocabulary: idiot, as*ho*e… when you can’t argue the issue you resort to name calling. THAT, my brother, is the behavior of higher ordered thinking.

  26. i like jackass.

did you ever see the one where he puts chicken in his underware and climbs on a rope above a water bog filled with crocodiles?

    brilliant stuff.

on another note, i didn’t like the simpsons until i started college. it was only then i began to “get” the many shakespearean influences…

  27. Chase: are you saying Stuie is Joe Napoli; I believe the words he used were “joke” and “idiot”, only one os which is four letters. Pleae clarify.
