Lathan says school will resume Monday

In this week’s “Remarkable Times,” the e-newsletter sent out by District 150, there’s this message from Dr. Grenita Lathan explaining why the schools have been closed so many days this week:

Peoria received its largest snowfall in many years and with it, Peoria Public Schools took one of its longest runs of consecutive snow days. School closures were not because of a lack of trying! In fact, we appreciate and congratulate the city, state and PPS staffs for a job well done! PPS would like to thank our Buildings and Grounds and Transportation employees for their tireless efforts to remove snow from our properties, parking lots and sidewalks, as well as for working to dig out our fleet of 150 buses. Our hand scheduling management Payroll staff and other twelve month employees also worked to keep the District operating during this time.

As mentioned above the District operates 150 buses and has 10,825 students eligible to ride the bus to and from school on any given day. When you combine those numbers and the amount of snow cleared from our city streets, it becomes clear why student safety is a concern. There are very few sidewalks cleared, forcing our students to wait or walk in the street. Add the large snow piles on street corners that block drivers’ views, and students’ safety becomes at risk.

I encourage our community, parents, neighbors and friends to help ensure a safe school day as we plan to return to school on Monday, by clearing sidewalks and driveways over the weekend, or at the least, a safe spot for students to stand as they wait for the bus. Drivers and students should also take extra caution during the school day.

With your assistance, we can help our students return to the classroom in a safe manner.

City: Residential plowing complete

The City sent out this announcement this morning at 6 a.m.:

Residential plowing is completed and 90% of alleys are being reported as plowed. The Snow Route Parking Ban is no longer in effect.

Even though residential plowing is completed, I’m told District 150 buses are still unable to traverse the residential streets, and that’s why school was cancelled today.

Day 4: No School for D150

From District 150:

For the safety of our students, all district schools will be closed on Friday, February 4, 2011. All events and activities are cancelled for Friday. This closure will guarantee that school buses will be able to safely transport students on Monday. Please check the district website www.psd150.org for further information.

All 12 month employees are to report to work as scheduled on Friday. If 12 month employees have personal safety concerns due to weather or road conditions, please plan to use a vacation day.

D150 closes for third day in a row

District 150 announced this afternoon that “Due to weather and road conditions, Peoria Public Schools will be closed on Thursday, February 3, 2011.”

I have to admit, I’m really surprised by this announcement, which I received via e-mail this afternoon from the District. Given that it hasn’t snowed any more since early this morning, and the City crews have been working around the clock, I really expected things to be clear enough by tomorrow that the buses could get through and school would be back in session. But I’m not complaining, either. It won’t hurt to give the City another day to get things cleaned up before the kids go back.

Peoria – Citing a long record of community involvement, Rick Cloyd announced today he is a write-in candidate for the Peoria Public School District 150 Board of Education from the 3rd district.

Because no one filed nominating petitions for the expiring Board term of Jim Stowell, anyone seeking the office will have to run as a write-in candidate in the April 5 general election.

“I’m a lifelong resident of Peoria, and as a graduate of Hines Primary and Richwoods High School, I’m a product of District 150,” Cloyd said in announcing his candidacy.

“This community must have a healthy and accountable public school system, because all of us – students, parents and taxpayers — have a big stake in the effectiveness of our local schools,” he said.

For three years, he and his wife Sally have volunteered with Carl Cannon’s ELITE youth outreach. “Our experience with ELITE really opened my eyes to the potential of Peoria’s youth. District 150 can, and must, provide a safe and respectful environment of educational excellence to help students realize that potential,” Cloyd said. He also taught a Junior Achievement economics classroom course for Richwoods High School seniors.

“In my career with Caterpillar, and as a former vice president of Keystone Steel & Wire Company, I’ve gained the business analysis, personnel management, organizational strategy and marketing experience the School Board needs,” he said.

“District 150 spends approximately $1 million per school day. Many business leaders seriously question what stakeholders are getting for that investment. This may be the most critical public body in our community, and it needs people with business experience to provide fact-based and accountable governance,” Cloyd said.

Cloyd, 62, graduated cum laude from Bradley University with a degree in journalism, and earned an MBA with emphasis in finance from the University of Illinois Executive program. He is employed by Caterpillar Inc. in Strategy & Business Development. Prior to joining Caterpillar, Cloyd was vice president of sales and marketing for Keystone in Bartonville, where he worked for 25 years.

Cloyd has served the community in a number of capacities, including as a member of the Greater Peoria YMCA board, and a volunteer with several other civic and charitable organizations.

According to Dave Haney’s blog, Cloyd lives at 9172 N. Picture Ridge Road. Also running as a write-in candidate: Jody Pitcher, 6109 N. Heather Oak Drive. Pitcher is a Republican Precinct Committee Person and the organizer of the Peoria 9-12 Project.

District 150’s TIF proposal

Tuesday night, Dr. David Kinney from District 150 presented a plan to mitigate the negative impact of a TIF by sharing some of the revenue with the school district. I mentioned in my live blog that he had distributed a PowerPoint handout to the council members; here is a copy of that handout:

I realize this is old news, but I just have to lodge my disappointment that not a single person filed to run for the District 150 school board from District 3. I really am at a loss for words over this turn of events, so I’ll just reprint this paragraph from the Journal Star’s editorial last week:

Yet not a soul in District 3, the most affluent of the three neighborhood zones from which School Board members are chosen, could muster the interest to jump in the race. It would be one thing if everybody was happy with the status quo in a school district on top of its game, but that clearly is not the case. It suggests that Peorians have checked out on District 150. If that doesn’t spell doom for the district, neither does it characterize a healthy situation.

That pretty much sums up my feelings, too.

Don’t be fooled by empty rhetoric from City officials

There’s an article in today’s Journal Star I just couldn’t let pass without comment.

City officials including Mayor Jim Ardis have … expressed some of their frustrations with other taxing bodies in Peoria — namely Peoria Public Schools District 150 — for increasing its property tax rate while the city avoids similar hikes despite increasing political pressure to do so.

Reporter John Sharp did a good job of covering what I’m about to say, but I just want to emphasize it: The City didn’t raise property taxes because it raised taxes on our natural gas bills. The mayor and city council members can crow all they want about how they didn’t raise our property taxes (and District 150 did), but the truth is that the City will be taking more money out of our pockets next year than District 150.

According to this report, “Under the projected rate next year [for District 150], the owner of a $100,000 home would expect to pay about $1,640, excluding any Homestead exemptions or increase in assessed valuation, an approximately $13 increase [emphasis added] above this year under the same determinations.” In contrast, the natural gas tax is “a 3.5 percent tax on gross receipts resulting in about $33 to $34 more [emphasis added] for the typical residential user each year.” So the average homeowner will only be paying $13 more next year to District 150, but $33 to $34 more to the City of Peoria, albeit by different means. The total dollar increases are also significantly different: the City’s natural gas tax raises $2.2 million in revenue, whereas District 150’s increase raises up to $900,000 in additional revenue.

Furthermore, guess who else gets to pay the natural gas tax? That’s right — District 150! So the council has raised taxes on the school district, and is now complaining that the school district is raising property taxes. To a certain extent, the City is really raising property taxes by proxy. District 150 doesn’t have the ability to tax natural gas, garbage, water, liquor, etc., like the City does. When their costs increase, they have to go to the property owners to get more revenue.

Keeping these facts in mind, consider these outrageous statements from City officials quoted in the article:

“It doesn’t seem like there has been a lot of consideration from the other taxing bodies to continue to (not) increase their portion (of the property tax).” [Mayor Ardis]

“We’re on the edges of a tax revolt in this country…. The bottom line is we have to live within our means. If we have to afford less government, we have to put less government in place.” [Eric Turner]

This from two members of the council who voted to spend $55 million on expanding the Civic Center, spend $37 million to build a hotel (including a $9 million developers fee), give away the $10 million Sears block for $1, give away the $2.8 million Kellar Branch for $1 (and indirectly cost the taxpayers $1.25 million for its acquisition by the Park District), back a $3.3 million loan to now-defunct Firefly Energy (resulting in over $1 million owed by the City)… need I go on?

“If you are a citizen of Peoria and open your tax bill each year, you will see your taxes have been increased year after year…. I do think it’s important we continue on the city side to hold our property taxes away from an increase.” [Ryan Spain]

Apparently, all other taxes are okay to raise. Fees on our water bills, taxes on our Ameren bills, sales taxes downtown, the continuation of HRA taxes to pay for the overbuilt Civic Center — these apparently don’t have any affect on citizens. As long as we “hold our property taxes away from an increase,” then the quality of life here is golden!

A word to the wise: Council members in glass houses shouldn’t throw stones.

Attorney General says D150 did not violate OMA

The Illinois Attorney General’s office issued the following ruling in a letter dated November 16, 2010:

Dear President Wolfmeyer:

On February 16 and February 18, 2010, this Office received three Requests for Review alleging a violation of the Open Meetings Act (OMA) (5 ILCS 120/1 et-seq.) by the Peoria School District 150 Board of Education. The Requests for Review raise questions whether the Board violated the requirements of OMA when four members of the Board attended a February 16, 2010 event with media and the District’s new Superintendent that was closed to the public.

On February 26, 2010, this Office sent a further inquiry letter to Board of Education President Deborah Wolfmeyer requesting the minutes and the audio recording of the event. On March 12, 2010, School District attorney David Walvoord responded to our further inquiry letter and supplied us with an audio copy of the meeting and a written explanation regarding the event.

In its written response to our letter, Mr. Walvoord confirmed that four members of the District’s seven-member board, including the President and Vice President, were present at the event. Clearly, therefore, more than a majority of a quorum of the Board was present and gathered at that time.

One requester was told by District Spokesperson Stacey Shangraw that the event was open only to “members of the professional press.”

This Office has reviewed the audio CD supplied to us by the District. The event’s timeline follows:

2:54- Primary speaker invites questions from the media “for us.”

4:07- In response to a question regarding whether deficits came up in the selection process, the primary speaker states, “I don’t think we got into those kinds of specifics,” and goes on to recount that Lathan shared “with us” an anecdote about a deficit she dealt with in her job with the San Diego school system.

6:00- In response to a question whether Lathan has unanimous support of the board, the primary speaker states “she has the full support of the board.”

13:00- At this point, multiple board members amplify previous answers. At least 3 board members appear to speak interactively at this point.

21:00- The primary speaker notes that “we” are paying for her expenses while she’s here.

23:00- A Board member other than primary speaker makes concluding remarks.

In his letter, Mr. Walvoord explains that the press conference did not violate OMA because the only comments made by Board members were in response to press questions and that there was no discussion or dialogue among the Board members present.

For purposes of OMA, a “meeting” is defined as a gathering of at least a majority of a quorum of the members of the public body held for the purpose of discussing public business. 5 ILCS 120/1.02. The phrase “discussing public business” refers to an exchange of views and ideas among public body members on a matter or matters germane to the affairs of their public body. It is not directed at casual remarks, but, in effectuation of section 1 of the Act (5 ILCS 120/1), at discussions that are deliberative in nature. A deliberation in this context is a discussion aimed primarily at reaching a decision on a matter of concern to the public body, regardless of whether the discussion will result in the taking of an action, will set policy or is preliminary to either. See, Guide to the Open Meetings Act, at 20 (Rev. 2004).

In this instance, we conclude that although a majority of a quorum of the Board was present at the February 16, 2010 event, the Board members did not engage in a deliberative discussion of public business, and thus, did not violate the Act. Based on our analysis of the audio recording, the comments made by the individual members in response to questions posed by the members of the media did not constitute a deliberative process aimed at setting policy or that could lead to a final decision by the Board. Accordingly, the gathering was not a “meeting,” for purposes of OMA.

Therefore, we find that further action is not warranted.

We would strongly suggest, however, that gatherings of this nature should be discouraged. Clearly, in these circumstances, the gathering of four members of the Board in a venue closed to the public caused serious questions to be raised as to the propriety of the event. Further, although a gathering may not be planned with the intention of discussing public business at its outset, the gathering is subject to conversion to a statutory “meeting” at any point. Thus, a gathering will becomes [sic] a “meeting,” for purposes of the Act, if the attention of the requisite number of public body members present turns to a deliberative discussion of public business, whether or not there was any intent to conduct a “meeting.” Had this occurred in these circumstances, a violation of the OMA would inevitably have happened.
